Even before the pandemic, international trade and investment frameworks were being challenged by rising protectionism and scepticism about open trade and investment, the US-China conflict and its spillover effects, and technological change.  These challenges are particularly important to Canada as a trading nation with significant inward and outward goods, services and investment interests.  This session will discuss changes that have important implications for Canadian businesses and their legal advisors related to:

  • Canada’s trade relationships with the US and Mexico, including the “new NAFTA” (CUSMA) which brings important changes to investor protections, IP rights and trade dispute mechanisms
  • Canada’s trade relationships with Pacific nations, including the strategic significance and implementation status of the new CPTPP, as well as trade and investment with China
  • Canada’s trade relationships with Europe, including the implications of the UK’s withdrawal from the EU, and hence CETA, for Canadian trade and investment flows
  • The status of the dispute resolution system in the World Trade Organization and the risks for Canadian companies when facing foreign government actions that are inconsistent with the rules governing international trade
  • The new foreign investment / national security review policy adopted by the Government of Canada in response to the pandemic challenges
