This program is part of the Deconstructing Ontario's New Construction Act Series.

On October 1, 2019, the new Prompt Payment & Adjudication regimes will transform the fundamental way that construction projects operate in Ontario. You need to be prepared.

Designed and delivered by an expert faculty of construction lawyers and industry specialists – many of whom helped to write the new law – this program will provide the critical information and practical strategies that owners, general/major trade contractors, subcontractors, trades and suppliers need to confidently adapt to the new prompt payment and adjudication regimes and to manage risk.

Topics include:

  • How to prepare for the new Prompt Payment regime:
    • a walk-through of the rules, requirements and transition issues
    • an in-depth analysis of the common pitfalls and how to avoid them
    • an update on risk, the practical implications and impacts on other remedies and areas of law
  • How to prepare for the new Adjudication regime:
    • a walk-through of the new fast-track system and how to make the process work for you
    • an examination of the common pitfalls, transition issues and how to avoid them
    • step-by-step guidance to conduct and manage a claim – from determining whether a matter may be adjudicated, through to determination and enforcement
    • what happens after adjudication? – an updated review of the post-adjudication legal framework, includes the impacts on other remedies and areas of law
  • Practical insights, tips and ‘lessons learned’ from early adopters and other jurisdictions from the perspectives of:
    • owners
    • GCs/major trade contractors
    • trades/subcontractors/suppliers
  • Federal and provincial legal reforms: what has been learned thus far?
  • What’s next? Legal updates and challenges to watch out for

Program Changes

We will make every effort to present the certificate program as advertised, but it may be necessary to change the dates, location, speakers or content with little or no notice. In the event of program cancellation, York University and Osgoode Hall Law School’s liability is limited to reimbursement of paid fees.

Cancellations and Substitutions

Substitution of registrants is permitted at any time. If you are unable to find a substitute, a full refund is available if a cancellation request is received in writing 14 days prior to the program date. If a cancellation request is made with less than 14 days notice, a $75 administration fee will apply. No other refund is available.
