Terms & Conditions – Osgoode’s Online NCA Exam Prep Program (the Program)

Pre-Purchase Terms and Conditions

  1. The use of the Program is governed by OsgoodePD’s Terms of Use.
  2. All sales are final and purchases are non-refundable. Please make all enquiries related to program content prior to purchase. In the event you experience technical difficulties, please contact opdsupport@osgoode.yorku.ca for assistance.
  3. You should purchase this product only if you plan to sit the corresponding NCA exam(s) in the next three sittings. Our Learning Management System (Moodle or LMS) at learn.osgoode.yorku.ca will ask you to identify your planned exam sitting before you are granted access to the course content.
  4. Each subject matter course entitles the participant to submit one written exam question answer through our LMS to be marked by the instructor. The participant may submit the answer at any time and must allow two weeks for the instructor to provide feedback. Participants may ask questions on the course discussion forums or directly to instructors through the course interface. Participants must allow up to one week for answers to be provided.
  5. If you purchase one or more courses at the Earlybird price (during April or May 2015), you acknowledge that course material will not immediately be available. Full course content is expected to be launched in June 2015, allowing 10-12 weeks of access in advance of the August 2015 NCA exam sittings.
  6. The Program is funded by Ontario’s Ministry of Citizenship, Immigration and International Trade (MCI). In order to manage course enrollment, continuously improve course content, and meet reporting obligations, OsgoodePD will collect information about participant use patterns, success rates on NCA exams, and progress through the licensing process. This information will be kept confidential by OsgoodePD and data will be reported to MCI on an anonymized basis. our Learning Management System (LMS) will ask you for consent to the collection and use of this information before you are granted access to the course content.
  7. If you self-identify as eligible for the MCI-funded Bridging components of the Program, our LMS will require you to provide proof of eligibility. Decisions as to eligibility for the Bridging Program are at OsgoodePD’s discretion and you will be granted access to the Bridging components once OsgoodePD has verified your eligibility and you have consented through the LMS to information collection and use for MCI reporting purposes. Ineligibility for the Bridging Program does not affect your access to the NCA subject matter courses.
  8. OsgoodePD makes no representation as to your eligibility for Ontario Bridging Participant Assistance Program funding.
  9. You will have access to each subject matter course until the week following your chosen exam sitting. If you advise the course manager through the LMS before your sitting that you have deferred your exam to a date no more than two sittings in the future, you will be granted extended access to the course until that later sitting. Only one such extension is permitted.
  10. Approximately 10-12 weeks after your chosen exam sitting, OsgoodePD will ask you, through our LMS, to confirm whether or not you have passed the exam. When you confirm that you have passed, you will be invited to join to Osgoode’s NCA alumni network and will benefit from a number of ongoing free resources. If you do not pass the exam, provide us with confirmation of your unsuccessful attempt and identify at which of the next two exam sittings you plan to retake. You will be granted one retake of the course at no additional charge with access provided until the end of that sitting. Only one free retake of the course is permitted.
  11. The discussion forums and other communication tools on our LMS are to be used for topics related to the courses and the NCA and licensing process. You may not sell services or products to other participants. The only exception is sale of used NCA subject matter textbooks, which may be discussed on the forum topics designated for textbook sale.
